PRETTY OS Terms of Service
Effective 10/31/2026
Please read carefully. These Terms include a rule that credits and fees are not refundable (Section 6), a section explaining that the Service or your Site may go offline, including if PRETTY OS shuts down (Section 15), limits on our liability (Section 17), and a binding individual arbitration agreement with a class-action waiver (Section 19).
1. Who we are and how you accept these Terms
These Terms of Service (the “Terms”) are a legal agreement between you and [Legal business name], doing business as PRETTY OS (“PRETTY OS”, “we”, “us”). They govern your use of the PRETTY OS website, the PRETTY OS website builder, the hosting of the websites you build, our templates, and related features and support (together, the “Service”).
You accept these Terms by creating an account, clicking a button or box that refers to them, buying a plan or credits, or using the Service. If you do not agree, do not use the Service. If you accept on behalf of a business, you confirm that you have the authority to bind it. Our Privacy Policy is part of these Terms and explains how we handle personal information.
2. Definitions
- Account: the PRETTY OS account registered to your email address.
- Site: a website you build using the Service, including its pages, code, database, files and published version.
- Input: the prompts, text, images and files you submit to the Service.
- Output: the code, text, designs, images and other material the Service generates from your Input.
- Your Content: your Input, your Output and your Sites, including information about your own clients and site visitors.
- Credits: the unit in which use of the Service is measured and billed.
- Technology Providers: the third parties that power the Service, such as AI model providers, website-building and hosting platforms, infrastructure providers and payment processors.
3. Eligibility and accounts
- Age. You must be at least 18 years old and able to form a binding contract. The Service is not for children.
- Your Account. You must give accurate information and keep it current. You are responsible for your password and for everything that happens under your Account. Tell us right away at hello@myprettyos.com if you think someone else is using it.
- One free Account per person. The free plan is offered once per person. You may not create or use more than one free Account, use bots or scripts to create Accounts, or use fake or disposable emails to get free credits more than once. If we find this, we may remove the credits, suspend or close the Accounts, and delete their Sites without refund.
- Sanctions. You may not use the Service if you are in a country or territory under comprehensive US sanctions, or if you are on a US restricted-party list.
4. The Service and AI generation
- What it does. PRETTY OS lets you describe a website in a chat and have an AI build, change and publish it, using templates made for beauty businesses.
- You are talking to an AI. The builder is an artificial-intelligence system, not a person.
- Changes and availability. We choose which AI models and technology power the Service and may change them, or change how the Service works, at any time. We do not promise any level of uptime. We may perform maintenance that affects availability.
- Beta features. Features labelled beta, preview or experimental may change or be removed at any time and are provided as is.
5. Plans, credits, billing and automatic renewal
5.1 Plans
The Service is offered on a free plan and a paid plan. The free plan includes 50 one-time credits. The paid plan costs $29 per month and includes 100 credits each billing month. The pricing page and checkout show the current plans and prices and control over this summary.
5.2 Credits
Building and changing a Site uses credits. The amount used depends on the work requested.
- Plan credits are granted at the start of each paid billing period. They expire at the end of that period and do not roll over.
- Add-on credits are credits you buy separately. They do not expire while your Account is open and in good standing, and they are used after plan credits.
- Nature of credits. Credits are a prepaid right to use the Service. They are not money, cannot be exchanged for cash, cannot be transferred, and have no value outside the Service. Free and promotional credits may be removed if they were obtained through abuse.
- If your credits run out during a build, the build stops and keeps the last working version.
5.3 Payment and taxes
Payments are processed by Stripe. You authorize us and Stripe to charge your payment method for your plan, add-on credits and any applicable taxes. Prices are in US dollars. You are responsible for any taxes we are not required to collect.
5.4 Automatic renewal
Automatic renewal notice. The paid plan renews automatically every month at the price then in effect until you cancel. Your payment method will be charged at each renewal. You can cancel at any time online in your Account settings. Cancellation takes effect at the end of the current billing period, you keep access until then, and no further charges are made.
5.5 Failed payments and chargebacks
If a payment fails, we may retry it, notify you, and pause paid features and published Sites until it succeeds. Please contact us at hello@myprettyos.com before disputing a charge with your bank. A chargeback that we show to be unjustified is a material breach of these Terms, and we may suspend your Account and recover the amount plus any fees we are charged.
5.6 Price changes
We may change prices, credit amounts and plan features. We will email you at least 30 days before a change affects you. It applies from your next renewal after the notice period. If you do not accept it, cancel before that renewal.
6. No refunds
Except where the law requires otherwise, all fees and credits are non-refundable. This includes unused plan credits, unused add-on credits, partial billing periods and closed Accounts. Credits are used up as the Service does work and as we pay third-party costs. We may, at our sole discretion, give a refund or credits in a particular case, for example if a build fails because of us. A goodwill refund does not waive this Section.
7. Your Sites and Your Content
7.1 You own Your Content
As between you and us, you own your Input and your Sites. We assign to you whatever rights we have in the Output generated for you, as long as you follow these Terms and pay what you owe. We do not promise that Output is protected by copyright, new or exclusive. Because AI produces similar results for similar requests, the same or similar Output may be generated for other users.
7.2 The license you give us
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, modify and process Your Content, and to let our Technology Providers do the same, only as needed to provide, secure, support and improve the Service, to follow the law, and to enforce these Terms. We may use aggregated information that does not identify you or your clients to improve and promote the Service.
7.3 You are responsible for what you publish
You are solely responsible for Your Content and your Site, including:
- the accuracy of your services, prices, hours, locations and claims about your work;
- having any license or credential your profession requires, and not implying credentials you do not have;
- having the right to use every photo, logo, before-and-after image and review you publish, and the consent of any client who appears in them;
- replacing any sample content the builder creates (names, prices, reviews, photos) with your own real content before you publish. Never publish invented reviews, credentials or awards as if they were real.
7.4 AI output needs your review
Output is produced by AI. It can be wrong, incomplete, out of date, insecure, inaccessible or similar to material owned by others. You must review your Site before you publish it and each time you change it. Output is not legal, tax, financial, medical or other professional advice. You are responsible for the security and legal compliance of your Site, including accessibility and consumer and advertising laws that apply to your business.
7.5 Templates
Templates are provided as is. Other users may use the same templates, and your Site may look similar to theirs.
7.6 Feedback
If you send us ideas or feedback, you give us a perpetual, worldwide, royalty-free license to use them without obligation to you.
8. Acceptable use
You may not use the Service to build, publish or do anything that:
- is illegal, fraudulent or deceptive, including scams, fake reviews and impersonation;
- infringes someone else’s intellectual property, privacy or other rights;
- includes malware, phishing, spam or unauthorized access to systems or data;
- includes sexual content involving minors, or content that incites violence or hatred, or harasses or threatens people;
- involves weapons, unlawful surveillance or discriminatory profiling;
- gets around our security, credit metering or the policies of our Technology Providers, or extracts or copies the models, prompts, templates or software behind the Service;
- resells or redistributes the Service, or uses it to build a competing website-building service, without our written permission.
Our Technology Providers require that everyone using the Service follows their usage policies. You agree to follow those policies as they are updated. We will give you a copy on request.
We do not monitor Your Content generally, but we may review it and remove it, unpublish a Site, limit features, or suspend or close an Account if we believe these rules have been broken. We will tell you what we did and why when we reasonably can, and you can reply to hello@myprettyos.com to ask us to reconsider.
9. Your visitors, clients and privacy
You are the publisher of your Site. You, not PRETTY OS, are responsible for your Site’s content, security and legal compliance, and for the personal information it collects from your clients and visitors.
- If your Site collects personal information (through booking links, contact forms, inquiry forms, cookies or analytics), you must post your own privacy policy and follow the laws that apply to you, including laws on marketing emails and text messages.
- We process that information only on your behalf to provide the Service.
- Do not collect or store through your Site: full payment card numbers (use a payment provider instead), health records or other protected health information, Social Security or government ID numbers, biometric data, or personal information from children under 13. If you need to take payments or health information, use a separate service built for it.
10. Domains and third-party services
If you connect a custom domain, you must own it or have permission to use it, and you are responsible for its registration, renewal and DNS settings. Booking apps, payment processors, email tools, social networks and other services you connect to your Site are separate services with their own terms and fees. You must follow their terms, and we are not responsible for them, their availability or their changes.
11. Our intellectual property
PRETTY OS, the Service, our templates, software, designs, trademarks and everything else we own or license (other than Your Content) belong to us and our licensors. We give you a limited, revocable, non-exclusive, non-transferable license to use the Service for your own business. You may not copy, sell, sublicense or reverse-engineer the Service, scrape it, probe its security without permission, or use our name or logos without our written consent.
Your Site may contain code and components that we or our Technology Providers own. You may keep using them as part of that Site, including after you export it, but not to build a competing website-building service.
12. Copyright complaints
We respond to notices of copyright infringement under the Digital Millennium Copyright Act. To report content, email hello@myprettyos.com with: your signature; the work you say was infringed; the URL of the material; your contact details; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the owner. If your content was removed by mistake, you may send a counter-notice with the same details, a statement that you believe the removal was a mistake, and your consent to the jurisdiction of the federal court for your district. We may close the Accounts of repeat infringers.
13. Exporting your Site and your data
You can download your Site’s code and data from your Account. Some export features may depend on your plan. Your Site is built in standard formats so it can run elsewhere, but exported Sites are not supported by us, and you are responsible for hosting them.
You are responsible for keeping your own copy of your Site. We are not responsible for loss of anything you have not exported. Backups on our side exist for our own recovery and are not a service we promise you can restore from.
14. Suspension and termination
- By you. You can cancel your plan at any time (Section 5.4) and close your Account by emailing hello@myprettyos.com.
- By us. We may suspend or close your Account, unpublish a Site or remove a feature if you break these Terms or the Acceptable Use rules, fail to pay, create a security or fraud risk, or if the law or a Technology Provider requires it. We may also end free Accounts or inactive Accounts. If we close your Account for breaking these Terms, we may do so without notice where the circumstances require it.
- What happens. When your Account is closed or your plan ends, your Sites may be taken offline. We may delete your Sites and Your Content 30 days after closure, except what we must keep by law. Credits you have left are forfeited and not refunded, except as stated in Section 6. Sections that by their nature should survive closure will survive.
15. Changes, discontinuation and shutdown
15.1 We can change or end the Service. We may change, suspend or discontinue the Service, any feature, or the hosting of any Site, at any time and for any reason. Reasons include a decision to close or sell the business, financial reasons, a change in or loss of a Technology Provider (including the platform that powers PRETTY OS), legal requirements, or events outside our control.
15.2 Your Site may go offline. If the Service is discontinued, if PRETTY OS goes out of business, or if a Technology Provider stops working with us, your Site may go offline and your Sites and data may be deleted. That is why you should keep your own copy of your Site, as described in Section 13.
15.3 Notice and export. If we decide to shut down the Service entirely, we will try to give you at least 30 days’ notice by email and keep export available during that time. We may not be able to do this, for example if a Technology Provider shuts down or suspends us suddenly, or because of events outside our control. Failure to give notice or keep export available does not give you any claim against us.
15.4 No recourse. To the maximum extent permitted by law, if the Service is discontinued or changed, if PRETTY OS closes, or if your Site goes offline, stops working or is deleted for any reason, you have no claim against us for refunds, damages, compensation, lost bookings, lost revenue or any other loss, and we have no obligation to keep your Site online, restore it or host it. Nothing in this Section limits liability that cannot be limited by law, such as liability for fraud or willful misconduct.
16. Disclaimer of warranties
To the maximum extent permitted by law, the Service, our templates and all Output are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We and our Technology Providers do not promise that the Service will be uninterrupted, secure or error-free, that Output will be accurate, complete, legally compliant or free of third-party rights, that your Site will stay online, or that your Site will bring you bookings, clients, revenue or any other result. You use the Service and rely on Output at your own risk.
17. Limitation of liability
To the maximum extent permitted by law, PRETTY OS, its owners, employees, contractors and Technology Providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, bookings, clients, goodwill or data, arising from the Service, Output, your Site, your clients or visitors, third-party services or the shutdown of the Service, under any legal theory, even if we were told such damage might happen.
To the maximum extent permitted by law, our total liability for all claims relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim and (b) US$100.
These limits do not apply to liability that cannot be excluded or limited by law, such as liability for fraud, gross negligence or willful misconduct. Some places do not allow certain limitations, so some of these may not apply to you. You agree these limits are an essential part of this agreement and that the Service is offered at its price because of them.
18. Indemnification
To the extent permitted by law, you will defend, indemnify and hold harmless PRETTY OS, its owners, employees, contractors and Technology Providers from claims, losses, damages, fines and costs (including reasonable legal fees) arising from: (a) Your Content and your Site, including claims by your clients, customers or visitors; (b) your breach of these Terms; (c) your violation of any law or anyone’s rights, including intellectual property and privacy rights; or (d) the acts of anyone using your Account.
19. Disputes: informal resolution, arbitration and class-action waiver
Arbitration notice. Except as stated below, you and PRETTY OS agree to resolve disputes through binding individual arbitration instead of court, and waive the right to a jury trial and to bring or join class actions. You can opt out within 30 days (Section 19.4).
19.1 Informal resolution first. Before starting arbitration or a court case, the party with a dispute must send a written notice describing it and the relief sought. Notices to us go to hello@myprettyos.com with the subject “Notice of Dispute”. The parties will try in good faith to resolve the dispute for 60 days.
19.2 Binding individual arbitration. If the dispute is not resolved, it will be settled by binding arbitration before a single arbitrator administered by the American Arbitration Association under its rules that apply to the dispute, including its Consumer Arbitration Rules where they apply. Arbitration may be conducted by video or in your county of residence. We will pay the arbitration fees we are required to pay under those rules. Either party may bring an individual claim in small-claims court, and either party may seek a court order to stop misuse of its intellectual property.
19.3 No class actions. Disputes may be brought only on an individual basis, and not as a plaintiff or class member in a class, collective or representative action. If this waiver is found unenforceable, the arbitration agreement does not apply to the class claims, which will go to court.
19.4 Opt-out. You may opt out of arbitration and the class-action waiver by emailing hello@myprettyos.com within 30 days after you first accept these Terms, with your name and Account email and a clear statement that you opt out.
19.5 Governing law. These Terms are governed by the laws of the State of [State], and the Federal Arbitration Act. Any dispute that is not subject to arbitration will be heard in the state or federal courts located in [State], and you consent to those courts.
19.6 Where the law differs. This Section does not apply where your local law does not allow it.
20. Changes to these Terms
We may update these Terms. If a change is material, we will notify you by email or in the Service at least 30 days before it takes effect. Updated Terms apply from the date stated. If you keep using the Service after that date, you accept the updated Terms. If you do not accept them, cancel your plan and stop using the Service before that date. The Terms in effect when you first accepted them are available on request.
21. Notices for specific places
- California residents. Under California Civil Code Section 1789.3, you are entitled to this notice: the Service is provided by [Legal business name], [mailing address]. Complaints may be sent to hello@myprettyos.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. Section 5.4 is intended to comply with the California Automatic Renewal Law.
- Reviews. Nothing in these Terms limits your right to post honest reviews of the Service.
- Outside the United States. PRETTY OS is operated from the United States and these Terms are written under US law. You may use the Service from elsewhere, but you are responsible for following your local laws. Mandatory consumer protections in your country that cannot be waived continue to apply to you.
22. General provisions
- Entire agreement. These Terms and the documents they refer to are the whole agreement between you and us about the Service.
- Severability. If a provision is found invalid, the rest stays in effect, except as stated in Section 19.3.
- No waiver. If we do not enforce a provision, that does not waive it.
- Assignment. You may not transfer these Terms or your Account without our written consent. We may transfer them, for example in a sale or merger of the business.
- Events outside our control. Neither of us is liable for delay or failure caused by events outside our reasonable control, including outages of Technology Providers, internet failures, government action and cyber-attacks. This does not excuse payment obligations.
- Notices. We may notify you by email to the address on your Account, in the Service, or on our website. Notices to us go to hello@myprettyos.com.
- Electronic agreement. You agree that your electronic acceptance has the same effect as a signature.
- Independent parties. These Terms do not create a partnership, agency or employment relationship.
- No third-party beneficiaries, except our Technology Providers and others named in Sections 17 and 18.
- Time limit on claims. To the extent the law allows, any claim relating to these Terms or the Service must be brought within one year after it arises, or it is permanently barred.
